Hi
There a POS at the side of my property, Nothing has been done with it for 2 years until yesterday when the workforce said a railing fence was been removed so people can use the space which means that people can walk right up to my boundary fence, dogs can use the area as a toilet and as there is a small wooden barrier fence people/ kids can jump on it and see over our 6ft fence into the back garden.
We have been trying for 2 years to buy the land, but the excuse is its not the developers anymore but it is also not the councils as Land reg is pending. Only phase 1 of the S38 application has been provisionally submitted phase 2 & 3 haven't so not adopted by the council
there is a maintenance company who are maintaining the plot now
where do i stand ?
who do i go to to buy this land ?
I don't want people looking into our home or over our fence
this is why we bought the house we did as it was private

If the owner doesn't want to sell there is nothing you can do.
It may be part of the planning application that piece of land has to be left as POS.0 -

Just to clarify - if the developer (or whoever) sells you the land, that won't mean it ceases to be 'Public Open Space'. So people and their dogs will probably still be able to walk on it.
If you want to fence it off and include it within your garden, you'll need planning consent for change of use for that. And the council may not grant it.
So you should see what council planning say before contemplating purchasing.
Maybe discuss it with the planning authority now. If they say there's no possibility of getting consent for change of use, then maybe you want to give up trying to find out who owns it, and trying to buy it.

You can download the title for the land to find out who owns it, and then contact them to ask whether they are interested in selling to you.KatV said:Hi

However, just because you want to buy, doesn't mean that they are under any obligation to sell, and as edddy says, even if they did, you might not be able to change the use to stop the public accessing it,.
As I understand it, you already have a 6 foot tall fence so your garden will still be pretty private - you may be able to improve on that the council may be sympathetic to a request to allow you to install a taller fence if you find that there are *actual* problems with people climbing or trying to get over your fence, and in that situation you could also contact whoever does own the land and ask if they can put measures in place on their side - perhaps planting some prickly shrubs, for instance.
