PCM - Parking charge notice - permit not visable
I have read the FAQ, but I just wanted some advice regarding my PCN.
I live in a block of flats with parking outside it and for a few years now PCM has been operating in the area, on one particular day my permit slid to the front of the windscreen and so it was barely visible and the PCM parking attended decided to give me a ticket. It's the same woman every day so she knows I always park there and that I am a resident.
Anyways I contacted the landowners and explained that we are residents and the permit fell under the windscreen (genuine mistake) they said they would email PCM to ask for the ticket to be canceled.
PCM responded to the land owners today with this message -
Good morning
Thank you for your email.
I have had a look at the PCN and can see that this has been issued correctly, as per the enforcement signage throughout the development a PCM permit must be fully displayed within the windscreen, which the driver has not done on this occasion. There is nothing visible to show that the permit is valid for use on this scheme.

I have spoken with the PCM scheme manager for the site, rather than making the PCN completely void when it does have cost implications, the driver needs to take a little responsibility for their error. I can offer the reduced rate of £36.00 to be paid immediately, to ovoer our admin costs at this stage. Please advise within the next 48hours if the resident wishes to accept this offer so that I can get this reduced on the system. Please note that should I not hear back within the next 48hours the PCN may continue to progress, at which stage I can no longer intervene.

So my question is what grounds do I have if any of winning this in court as I am tempted to just pay the 36 for the peace of mind.

An ex-clamper firm outed as a 'rogue trader' on Watchdog isn't worthy of your money and as you say, the ticketer knows the cars and permits and was acting in a predatory manner that day. Why does that earn them £36?

and complain to your MP,You never know how far you can go until you go too far.2 -
Tell the landowner that their contractor who they should control better is playing silly devils and as they have told them to cancel why they haven't they, in any case the usual admin good will gesture is never more than £20.
