Personal loan taken out against joint property without my knowledge

So I am at the end ( or so I thought) if a long battle with my narcissistic ex partner to take over the mortgage in my sole name. Solicitor went to complete late week and transfer deeds etc and they have come back and said that Santander say there is a loan secured on the mortgage so will take a bit longer to prepare my redemption statement. WTH! 
Didn’t learn this until after 5 so couldn’t speak to Santander until the morning. How is this possible? Surely the loan company would have to verify with me and Santander? Is there a way of checking?

    Is "the loan company" somebody other than Santander? If not then in theory this is possible - they can use the mortgage as security for loans in joint or sole names.

    Is the loan really secured against the mortgage rather than the property? A loan could have been secured against the property in a number of ways including your ex defaulting on an unsecured loan and the creditor seeking a charging order secured against the property but without more information we’re just guessing.

    Not necessarily messy unless he denies it's his loan. Just needs the sums amended to take account of it.

    30year ago when I bought out my ex there were a couple of documents that weren't updated so I had fun convincing Legal & General that all of the three endowment policies were only payable to me when they matured!  I didn't want to track down my ex to ask him to release the money to me.  It was odd that the ex remained a life assured even though I'd bought him out of the endowments (not that he'd ever contributed!).  Speaking to L&G back then I said it was rather tempting me to bump him off rather than keep paying into those awful saving schemes that were never going to pay off my mortgage!  The phone line went rather quiet!  I have to say there were times when I was very close to considering that option (good job I didn't know where he lived!).

    OP you have my sympathies and I hope you get everything resolved asap so that you can get on with your life.  In 20-30 years time you will hardly ever look back until you read a similar thread on here.  Best of luck!
