Hi, we booked a hotel via booking.com in 2019 for June 2020, cancelled due to covid, moved to 24June 2021flights cancelled due to covid, on both occasions booking.com have said we must sort out with hotel, anyone know if this is right please? I thought as we paid booking.com they were our agents, our contract is with them? Now the hotel have said they only have our deposit, booking.com say they paid hotel in full. Can anyone advise please?

I would argue that they're an agent, but their own terms would argue that they're not. I'm pretty sure a court would agree with us though.

As this is not a package holiday (but may be a linked travel arrangement in some circumstances, mainly if you clicked through on an airline site within 24 hours of booking flights the first time around, usually to be rewarded by the airline), your rights may be limited.

When were the flights cancelled? If within 2 weeks of the flight, you may have more luck arguing with the airline for a re-routing (assuming the country will let you in) than arguing with Booking in the short term.

  • Booking.com is a direct distribution platform. Your contract will be with the hotel. It’s not clear what you are asking of booking.com though?

If it’s some sort of goodwill gesture re moving your non-refundable hotel again due to cancellation of flights this is entirely up to the hotel whether they allow this.

It's down to the hotel - if it's a non-refundable room you're entirely relying on the hotel's goodwill.
