OP used the wrong terminology ... they've identified flaws in the C's WS which they've noted down and will raise in the hearing. :)

If there's time to issue a SWS then they could also point out the flaws in there, plus include the Recorder Cohen judgment C-m mentions.

They have harassed you, interfered with your leashold rights, possibly infringed on your privacy, possibly trespassed, and wasted your time.  Read this and waste theirs.

Also ask your landlord to bring it to the attention of the MA/MC

    Well done.  :)

I really hope that the new CoP is robust enough to stop these residential claims in their tracks.

As I have said before on several occasions these are some of the worst scenarios as they impact on a person's right to enjoy their property.

If (like myself) you park on a random car park and receive a parking ticket then you can fight your corner and draw a line under it. Not so with the residental claims and some receive mulitple tickets.

    All done, case dismissed.

Didn't even get to most of my points, judge was satisfied the signage was prohibited and offered no contract but the judgement was based on my tenancy agreement offering no requirements and being given a key fob considered permission and unfettered access to park, as the car park is for residents which I was.
    Very well done!

And REALLY IMPORTANT PLEASE - DO US AND YOURSELF A FAVOUR AND MAKE A DIFFERENCE:

Please, please come back in August to check and make sure your voice - AND YOUR FRIENDS’ AND RELATIVES’ VOICES TOO -  is/are not missed from this final opportunity to take part in the Government Consultation, coming very soon.

Did you know that, whilst the lower level is to be £50 in future, the MHCLG has said that they think residential car parks should have a double punitive PCN level of £100?!

People like you need to show your evidence of what is actually happening to residents and that it is you (not trespassers) who are being targeted. The Government is listening and this will be your and your neighbours chance to tell them about the misery of having a PPC in your private key fob car park, and tell them that residents MUST be protected from PPCs like your ex clampers.

If the MHCLG stick to £100 for trespassers in residential car parks, the quid pro quo for that, I think, is that residents are all exempted at source in a white list, with no requirement to display any paper permit.  PCNs should only be issued to residents in exceptional circumstances where they are blocking a gate or in an accessible bay.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
