Section 75

I have recently bought an item via ebay and the item appears to be faulty and misrepresented.Can i claim under section 75 ?or is ebay an intermediary in this case .From what i gather if i had used paypal then i would have a very low chance under section 75 but i have in this instance used mastercard to pay for the item are they not jointly liable for the purchase?

Any replies much appreciated thanks

    Ebay will usually be considered an intermediary for s75 purposes - who shows as the merchant on your card statement, and under whose terms was the purchase made?  Chances are that Ebay's dispute processes will be more applicable than trying to pin it on your card....

    normally you can simply return the item - under the drop-down box 'reason' select 'other' and then 'item faulty' and the seller will have to pay return postage

    also, try posting in the ebay board there are some knowledgeable people there
