If you want qualified legal advice you should pay for it rather than seek advice from unqualified members of a forum.artschool2 said:
the car has a fault that has been back 6 times to get fixed from within two weeks of ownership.Your other comments about no relevance is incorrect and I dont think you understand the legal issues.MattMattMattUK said:
You are entirely within your rights to do this, but remember that to make any complaint stick you need a valid legal basis, not just "I don't like it".artschool2 said:I am able to go back to the main dealer via the motor ombudsman as the finance company are being ridiculous, I will also be going to the Financial Ombudsman regarding their letters.
The issue there is that whilst you might feel it is not warranted, that is of no relevance and it entirely depends what is in the contract and the relevant law.artschool2 said:thanks for all the feedback/help but in a nutshell circa £400 pcm for a low milage A class is not warranted.
What they make afterwards is irrelevant, the amount to be paid is set out via legislation and contract.artschool2 said:essentially both the garage and the finance company would be making plenty of money selling a car with a fault.0 -
its all being sorted because I got some great advice from the motor ombudsman and both the garage and the finance company are in the wrong on this one.visidigi said:
The problem is - depreciation is not linear.artschool2 said:I am able to go back to the main dealer via the motor ombudsman as the finance company are being ridiculous, I will also be going to the Financial Ombudsman regarding their letters.

Whats the trade in value/webuyanycar value of the car with everything declared out? (not the lemon bit bit the mileage and any damage)
That's your guide value. Not an Autotrader search of a comparable car on sale (and remember, current values are abnormally high - so your value is to be based on what you paid originally)...0 -
As they always seem to be when a number of qualified/experienced members on here don't give the answer you wantartschool2 said:

Very surprised that the Motor Ombudsman would give anything without you having exhausted the dealers complaints process3 -
Not as surprised as I am that they have managed to bypass the large backlog there ...0

dealer complaints process was already finished. thats why I went to finance company. Motor Ombudsman are being very helpful and yes I might have to wait for the process to complete but I am not bothered abut that.k3lvc said:As they always seem to be when a number of qualified/experienced members on here don't give the answer you want

I have previously had some amazing advice on this forum and been able to help others with the areas that I specialise in (construction).
being honest some of the comments are extremely unhelpful when I am in a position that is not of my making. I have given the garage every opportunity to fix the fault and I am not about to get ripped off.0
