Thai Airways refund after restructuring

I had bought tickets with Thai for 4 adults and 3 children to go to Phuket, Easter 2020. Obviously cancelled and I took their offer of vouchers. I then used the vouchers to rebook for Easter 2021, again cancelled.
Despite numerous contacts with Thai on various platforms, there is no sign of my refund of over £5.5k.
I tried a section 75 claim with M&S my credit card, but this was turned down, as Thai Airways are not actually bankrupt.

It seems the airline has now had its restructuring plans agreed by the bankruptcy court. My question is when and whether refunds will be paid out?

I think you will just have to follow the local media reporting on the restructuring plan and if the outcome is the "new Thai" is not taking on the debts of the old Thai, then re-approach your credit card company with proof and relevant new information.

Google brings up lots of information on the situation.

Westin is absolutely right, it may be a case of 'wait and see' however if recent restructures are a guide, you may be talking to your credit card company again. The 'new' Norwegian left 34,000 passengers without refunds, the 'new' Virgin Australia also left the old debts in the old company. Thai however is effectively owned by the government  and might take a different view in order to encourage tourists back on due course

Section 75 doesn't require the merchant to be bankrupt, it simply makes the credit card company jointly liable for qualifying purchases. The merchant could be fully trading and happy to deal with the issue but you could still decide you'd rather have your bank than the merchant deal with it.

I'd certainly go back and double check both the grounds you stated for the S75 claim and their grounds for rejecting it. If you said the grounds for breach of contract was bankruptcy then you created the unnecessary problem... the issue should have simply been presented as the merchant failed to supply the goods/service bought.
