PPI

I took a loan out with my ex 20 years ago shortly after that he left. I was the main account holder I added him when he got a job. I found out from our daughter last year that he had taken out a ppi claim on the loan and was Intending to try and keep it himself. Obviously gladstone Brooks found out it was a joint account and awarded him half or so he says. All the way through the claim process I wasn't informed and only knew because he had to tell me, at the time I was angry that he tried to take it all and refused to sign anything. Now he is saying they sent him a cheque for his half and when I rang gladstone Brooks they said he would have to ring to give consent for me to talk about the ppi claim which he is refusing to. I'm not sure how to remedy this and need advice on what to do. And also how he did it without my knowledge as I was the original account holder.

    Loans don't have main account holders. They're either sole or joint.

    Check with the lender whether a complaint for the whole loan was upheld. If so, they should be able to advise you who hold the redress. It's unlikely they gave it all to GB.

    Ignore Gladstone and speak directly to the lender. It’s more than likely they’ll have only paid him his half and would have been waiting for you to get in contact, but either way don’t engage with GB as they may try their arm and try and invoice you.

  • We both signed for the loan I only said about it originally being opened by me because he is saying he added me to the account. I talked to GB but because he made the claim they won't tell me a thing. He did say that my share was there but without his consent I'm getting no where. I also talked to the bank and they won't talk to me without ID so I have to go into the branch with it. I'm unsure if they will sort it if I do otherwise I have lost my half because he won't authorise me to talk.

    The claims company didn't award him anything.  The lender would have received a request to investigate the sale and decided it was missold.  If it was a joint loan, then he gets half and you get half.

    Now he is saying they sent him a cheque for his half and when I rang gladstone Brooks they said he would have to ring to give consent for me to talk about the ppi claim which he is refusing to.

    You don't involve the CMC as they have no contract with you.  You contact the bank and tell them that a joint loan has had an upheld complaint and you wish to receive your half.  The bank will pay it to you directly.
