Smart Parking Tower Road Newquay Cornwall.

Over the weekend of 14/15/16/5/2021  on a stay and visit to Newquay our vehicle was parked on a car park next to Newquay Golf Club. We are not from the area and on the approach to the town centre from both directions there were mobile electronic road signs stating that parking charges were suspended until 17/5/2021. We were not aware that there were different categories of car parks in Newquay. On entering the carpark we enquired from other motorists who had parked there if the car parking was free until 17/5/2021. These other motorists confirmed to us that it was. We parked in this particular car park for periods over two days.
So on our return from our stay in Newquay, after a week or so we were surprised to receive two parking tickets from Smart Parking, the fines ranging from between £60-£100 depending when you paid the fine.  Appeals were submitted to the above mentioned company and they rejected them both.
My query is I suspect that many motorists were caught out by the confusion over suspended parking charges in Newquay and we were just wondering if others have experienced the same issue as ourselves and if so how did they deal with it.  Regards Fed010.

    They are not fines.
    The relaxation of charges would have been for council run car parks, not private ones. Unless there were signs in the private car park stating that payment was not required, the driver should have followed the terms and conditions on the signs for parking.

    What happed when the keeper complained to the landowner?

    What did you put in the appeal? I hope you didn't reveal the driver's identity.
    You will have received a PoPLA code with the rejection. Have you appealed to PoPLA yet? 
    If not, construct PoPLA appeals for each charge using all the template points available to you in the third post of the NEWBIES thread.

    These will include at least,
    Not the landowner
    No standing to issue charges
    Inadequate signage
    Non PoFA compliant NTK (unless the identity of the driver was given during the initial appeal stage).
    BPA CoP failures
    Anything else relevant.

    Post your draft appeals here for checking before you submit them. Note that PoPLA codes last for 32 days.

    So sorry but very few drivers would’ve caught by that. You can’t read a sign on street and assume it relates to private car parks.  Drivers need to understand the difference between Local Authority parking and private parking in at parks, and it’s not unique to Newquay. 

    Having said that, there is never a need for a thread about Smart Parking as they are easily beaten by using the approach explained in the NEWBIES thread,as long as no-one phones up or appeals badly admitting to driving...
