A chargeback is always against Amazon but their agreements with the merchants allows them to then recoup the money from them. I don't know about Amazon explicitly but many similar services hold back a find of the sellers money to cover such claims.flippaxxx said:I’m hitting a brick wall with Amazon but still trying to progress down that route in tandem. My understanding is that a chargeback is effectively a forced refund (which they can dispute but said they won’t) so why they can’t just refund directly is crazy. They have no contact or accounts with the seller so it would be a chargeback to Amazon...All their management are now saying is “get a handyman to repair it” which is frankly insulting (it’s a specialist piece of kit and it’s the electrics that are faulty - I’d rather not risk a fire thanks) but believe me I will keep trying.
I can’t even download the invoice any more on the account because they have been removed from the marketplace which is another issue...
I will certainly be thinking twice before buying anything again that’s not direct from Amazon that’s for sure. How they can just kick sellers off and shrug their shoulders with no recourse is ridiculous.
If they simply settle the matter as a gesture of goodwill they may not have any right of recovery from the seller.
As has been said, the law and ombudsman see the S75 matter as very clear cut... https://www.financial-ombudsman.org.uk/files/297760/DRN-1103505.pdf is just one of the recent examples where the ombudsman declined a S75 complaint because amazon was a middleman in the transaction.0
