Unusual discrepancy over roof in title deeds - anyone have experience of this?

    The fact the other flat straddles both buildings (presumably they were knocked together at some point) makes a bit more complex and unusual - you'd certainly expect them to contribute to the shared roof (i.e. above "your" flat), and in a normal tenement setup you would normally share all of the roof costs among all flats in the block, even if the work isn't directly above yours. I'd expect the roof of the other building to be solely their responsibility. If they're bundling together "their" roof into the mix too, I suppose the question is whether the shares of costs make sense and whether you're paying more than your fair share given the relative sizes of the flats.

    Thanks for taking the time to respond guys. I know things can be different in Scotland but I do wonder if that's  something that would be consistent. Gives me something to read about in the waiting period. I will update the forum when I get a definitive answer, may help others in future.

    It's actually not something I'd be personally bothered by, I don't think it would cause many issues. Our solicitor is advising this may impact whether our lender would lend  though and could impact future sales. It's our first property we are buying so I guess if it pans out that way and that's the advice as much as it absolutely pains me, I'll need to take it.
