the best thing to do is go to Welfare rights you`ll find the number in the phone book or try google[search engine]I know a lady who won a six figure sum at the Bingo and was claiming IS and HB she paid it all back and that was it.

good luck we`re all thinking about you and your son
please do not pick on me for my grammar,I left school at fifteen and worked in the building trade for 55years ,

  • Unfortunately, if the said relative is willing to say money is actually theirs & provide a statement to this effect then it is difficult for the DWP to prove otherwise.

Another thing that happens often is claimant is found to have undeclared capital by DWP & when contacted by DWP about it, claimant withdraws savings & claims to have returned it to relative, for whom they were looking after it, & now said relative has mysteriously disapeared & thus cannot give supporting evidence to say that the money was being looked after on their behalf by claimant.

I doubt the DWP would buy that. I would expect the claimant to be done for fraud, unless they can prove it went to a relatives bank account.

I just think they would make their problems worse by being this dishonest.

So anyone caught in the same situation should just say "It wasnt my money it was for my son/daughter/father/mother etc, etc. and that means nothing will happen ??
They must look at the activity on the account, if alot of money is been deposited then withdrawn often then maybe it isn't for the children. I have an account for my children that only has money been deposited, money has never been withdrawn, but I suppose it would still be hard to prove that this money is intended for my children.

My sil was in a similar situation, her son had received some compensation for a car accident that he was in, she open an account for him and this money was for him only. The only thing was the account was in her name and she was on income support.

Someone came round to see her, they told her if the money was for her son she had to open a child trust fund in his name, if this was not done then she would have to pay back benefits
  • Thats what I did opened an ISA for my child as he got older. It was in my name as children cant have ISA's.

but its impossible to prove it is for my child even though I hadnt spent any of it. In fact I was going to move it to a childrens account but never got round to it.
They havent given me that option of moving it to a trust fund.

I will just have to pay any over payment.

Going on to previous quote you have to provide bank statements. so the people who say it has gone to a relative would have to provide all past statments.

so if the DSS saw the money came from their previous job or benefits, which would come up on the statement then they have got them for fraud.

I cant believe the DSS are that stupid to just accept the mysterious relative story and just close the case.It would be passed to fraud dept.
