My response to the latest by Gladstones saying court action is imminent. Replies from Gladstones have been email hence my last statement. I've also included the above:
"As I mentioned in my previous correspondence I am the leaseholder and resident of X. My vehicle was parked in a Visitor’s Parking Space as instructed by the Managing Agent. I have already provided evidence in support of this. The PCN issue was between date1 and date2 when I was in self-isolation due to coronavirus symptoms. I have already provided evidence in support of this.
I have acted in accordance with my lease and the instructions provided by the Managing Agent of the land. During the self-isolation period I was acting in accordance with the government rules for coronavirus pandemic. There is no requirement in my lease to display a permit when parking in a Visitor’s Parking Space. Your client must have checked the Head Lease before any parking enforcement commenced, to avoid penalising resident leaseholders who already had rights and easements. Please disclose the discussions with the Managing Agents at the time and a copy of the Head Lease your client considered.
As the Lessee I pay service charges which includes the expenses incurred by the Manager for the maintenance of the main structures such as the Visitors’ Parking Spaces. How has your client incurred a loss with my use of the Visitor’s Parking Space that I pay to maintain? Please provide details of how your client has incurred the loss stated in the PCN.
