We HMRC have suspended collection of the refunded amount while under appeal, If your appeal in not successful interest will be applied from the payment due date.
HMRC have not done anything wrong in making the refund. Your dispute is with FTR.

OP was scammed. I am amazed anyone would give access to their Gateway account. Surprised they did not ask for access to his bank account so they could pay in the "refund""A nation's greatness is measured by how it treats its weakest members." ~ Mahatma Gandhi

Update: I've yet to hear back from FTR in relation to the SAR or LBA. I've not yet responded to HMRC as per my last reply quoting their email response.
Note: a different friend of mine claims that he has spoken to HMRC and ONLY has to pay back what he was given by FTR, which seems interesting....).

It may be that HMRC pursued FTR for the money they kept. I am surprised though, and would ask the friend for copies of the correspondence.0

I'm not acting on the information he's given me, I just thought it would be interesting to share.
He's actually one of the ones I referred after getting my payment, after I was originally referred by someone else.0
