Faulty tv from John Lewis

Hi my name is Drew first time posting on here. Hope you guys can help. My daughter bout £600 Sony Bravia tv from JL online. JL delivered to her top floor flat in dec. 2019 . She had issues with furniture deliveries and building work being finished so delayed moving in . Then hit with COVID lockdowns didn’t move in until late July. Set up tv wouldn’t work screen covered in lines. Also Ariel connection was bent . JL sent out engineer reports as impact damage . Not covered in warranty. Offered £250 goodwill . Not happy went down route of small claims . Had case management discussion on phone with sheriff and their solicitor sheriff didn’t take COVID into account just read rule that over 6months so I need to provide evidence that tv was delivered damaged ! Now case is going to court . Their solicitor asked me to phone him basically saying I will have hard job convincing sheriff and it will cost me a lot of money if I loose additional expenses what should I do ?

You should have got the independent report showing it was a manufacturing fault prior to starting the small claims process.

Are you disputing its impact damage? A bent connector is much more likely to be impact damage than it is a manufacturing fault so in this case not sure how much an engineers report is really going to help.

Six months at the flat plus building work .Not inspected on delivery .
Problem is a damaged connector  found six month later .
The £250 was an excellent offer for TV to be repaired .

Lack of inspection on delivery and some actual damage to the TV means you're probably going to have a hard time with this one!
COVID etc doesn't really have an impact on anything here - you should always test and inspect any expensive products on delivery for this reason. They have no idea what's happened in that time.

I'd advice your daughter to drop the action and see if they'll honour their original £250 offer.  The circumstances and timeline you describe make it plausible the TV was damaged in your daughter's possession - deliveries and furniture arriving, being moved about, etc.

You mention your daughter as the purchaser, but the retailer's representative is now dealing with you?  How did that come about?  If she's able to, it's better for your daughter to be dealing with it.  You have no consumer rights as you are not he purchaser.

The main fault with tv is the screen basically when switched on looks like white cracked lines all over it the aerial connector is another fault but the tv can’t be repaired. Also I am acting as the lay representative my daughter is too nervous about speaking up in court .

What did the report say about this fault/damage or was the entire issue reported as impact damage?

The entire issue was reported as impact damage. But apart from the Arial connector being bent there were no external signs of impact damage. We were going to get an independent engineer to look at it but JL said there was no point as theirs had already examined it.
