Retrospective Overpaid for House Share

New relationship 6 years ago. My rental lease ran out . Partner suggested I buy in to her property, I did on 50/50/TIC agreement. Relationship over she wants to buy me out but I think I paid too much at start. My buy in was based on what estate agents said at time but looks like it was over valued by 20-30k. Now currently 2 beds have not gone up like others and I may only make 15-20k on my original investment. Can I get more through the Courts , do I have a claim. Cheers.

Unlikely by the time you’ve paid all the solicitors costs. You can’t make a claim in the basis the housing market hasn’t done as well for 2 beds as you anticipated.

She wants to buy you out, you name your price and negotiate. If you can't agree, you can force a sale and then you will get what is legally your due minus all the associated costs of forcing the sale.

Using current on the market for sale of similar property in same area that is the agents asking price.0

Thanks Soot2006. I’m told that Courts will only use RICS valuation in these cases which is a lot less than agents market assessments.0

Negotiate, go to court and most likely by the time fee's are paid you will come out with even less, often better to lose 10K and get on with your life then spend 9-11K on legal bills to get 10K back. Of course no shortage of solicitors willing to take your money whether the success is likely or not.
