    I guess it's possible that the surveyor's plan will be sent to the neighbour, asking for comments. If the neighbour objects, maybe it will be changed.

    Also, if the only gate to both gardens is in your part of the garden, I guess it's likely that the neighbour will be given a right of way through your garden.

    In that case, you'd have to include a gate in your new fence, to allow the neighbour through.

    I don’t think he can object, if the plans are being drawn up by the owner of the building and two properties ( which is the council) ... downstairs is council by the way....I have seen other ex council properties similar to mine being sold and the fence boundaries are similar to what the surveyor told me.  The downstairs neighbour has his own back door to access his garden. The only access for me is through the outside side gate.  So it wouldn’t make sense for it to be shared . 

    And no when I moved in, on my tenancy it did not say anything about the garden, the housing officer said she will put in the deeds /boundaries through the post and they never. To be fair I didn’t really chase it up .
