Private parking firms - coronavirus panic

Hi folks,
As some of you know the corona period was/is a time when parking companies let off a flurry of backdated tickets.
I've received several dating back too 2018. Issue is when writing my defense i cant think of a good reason/evidence as to why i dont have to pay.
I've admitted to being the registered keeper of the vehicle and included past precedent such as parkingeye v beavis, consumer rights acr 2015, excel v wilkinson etc but when it comes to my personal defense i dont really have one.

Any ideas/ assistance would be much appreciated, as i' neck deep in tickets and up coming court hearings, its quite overwhelming, considering i work full time and a full time student MH nurse.

Thanks in advance

OK, you must tell us more

    * where did you attract the parking tickets ?
    * How much was each ticket
    * What are the dates of the tickets

Which legal is handling this and which parking company

but when it comes to my personal defense i dont really have one.
Why not?  Are all the claims about the same site?

    What were the circumstances?

What did you put as your defence and did you get more than one claim?

i' neck deep in tickets and up coming court hearings, its quite overwhelming,
But they should be consolidated into one hearing, if these are from the same Claimant. This is covered in loads of threads, search Henderson v Henderson.

Or, dare I ask, are you a serial collector of PCNs from various PPCs and thought they'd just go away?

Have you actually got court claims yet and have you defended yet?  Your first post is to vague on where you are at and what happened.

Hi guys sorry i was a bit vague.
So i have cases that are in the courts.
case 1 and 3 are at the same location and have multiple tickets rolled into each claim - Cervantes house,Harrow.
Thing is the company has changed name and is using different legal firms case 1 observices and case 2 gladstone, and the 2nd case BW legal.
These tickets all date back to 2018.

Case 1, 2 tickets, £458.98. i have a phone hearing on 3 Aug - After sending in my defense i have no evidence on my behalf. Other than past precedent.
Case 2 - I'm quite happy with and received great support from this forum and a friend, plus the height of the sign and my trying to use their dilapidated machine, im happy with.
Case 3 - 4 tickets, £890.72. The defence has to be in by the 12th of June, i have the past precedents but as far as my personal defense i have nothing, i dont even recall these tickets, as the company doesnt even leave PCN's, they do drive by photos.

Alot of text here my apologies, its case 1 and 3 i would appreciate any assistance with.

    Thanks

I'm not a serial collector, this place is located right outside my flat, so i would leave it there for a short while, then move it. All these tickets are from 3 years ago, they all resurfaced during corona period

Well you MUST file a witness statement and evidence, and you can rely on Jopson v Homeguard if you were a resident and had right of way over this car park, or a right to stop to unload or even park.  Your tenancy agreement will tell you what rights and easements you enjoyed, unless this car park isn't attached to the flats.

And of course you have the argument that the signs are unclear and cluttered and they don't allow for false 'admin/recovery' costs to be slapped on top of £100.

And of course you need to copy what everyone else does when claims are splintered up into more than one claim, when they deal with duplicate facts.  It is wholly unacceptable that you have top go through two hearings just because this rogue parking firm has split them up and used two firms of solicitors to make the costs higher and the harassment worse for you,. not to mention wasting the coyrt's time by having two hearings, unnecessarily.

Why are you not copying a defence that mentions Henderson v Henderson and asks for the claims to be consolidated as they deaf with the exact same facts?  We have loads of cases where people had more than one claim and have used standard wording objecting to this, in their defence and in witness statements.

Defence deadlines are never on a Sat/Sun/Bank Hol so it it probably 14th June.  There is no "s" in defence.  What was the date of issue of the claim form (N1) relating to this one?  If you post that date and the date you submitted your AoS then @KeithP will give you the correct deadline for your defence.
