Party Wall Settlement - what if company goes bust?

After an extremely prolonged period of 4 yrs from a construction company cracking our house inside and out through very close piling works to now finally attending zoom meetings with the party wall surveyor to agree on repairs and damages, we are being a bit strong armed by the surveyor as they suggest the constructor may go bust soon. Does anybody know our rights here please?? I guess we can’t take a ltd company to court if they’ve gone bust?

    Do they have public liability insurance or similar who would pick up the bill if they go bust, or pick it up anyway?
