End of Tenancy

Hi there

Just after a bit of advice. 

I have been in the rental property I have just given notice on for 10 years.  The deposit was on a promissory by the British Legion as I had to vacate a married quarter after my marriage broke down and they were fantastic in helping me. What happens regarding that as I was never asked to build up a deposit. 

During the 10 years here all and any damages have been reported directly to the Letting Agents. There has been no renovations done in the time I’ve been here and the carpets were written off 5 years ago. I have a dog so said I’m fine with them and it means I didn’t have to worry if anything stained them. The stair carpet was threadbare up the sides when I moved in anyway. 

Can the LA insist I get these professionally cleaned even though they are threadbare and written off?

Can the Letting Agent also insist I get a professional cleaning service in?

    No, the letting agency can’t insist upon professional cleaners. You just need to leave the property in the same condition as it was in at the start of your tenancy minus any fair wear and tear. How you achieve that is up to you. You can hire cleaners or you can apply some elbow grease, the choice is yours not the letting agent’s.

    Wear and tear and cleaning are separate issues.  Everything should be cleaned at least to the same level as when you moved in, even if it has suffered wear and tear in the meantime.  (Unless the L has specifically told you they will be replacing so not to bother with certain items).

    After 10 years of solid rent income and no void, the LL should be planning to refurbish the property through to make it ready for next rental - in such a case, tenant should simply get the full deposit back regardless.  That's my view any way.

    Agreed, full deposit should be returned.  If they won;t agree go to deposit scheme dispute process.  Greedy agent/landlord (or, I suppose, profoundly ignorant)
