Within 30 days you're entitled to a full refund but, for motor vehicles, after 30 days the refund can be reduced (for other items it's 6 months before it can be reduced). Is there no legal basis for recouping some of the money at all?
Also, you wouldn't need to prove he was aware of the issues. Only that the goods didn't conform to contract and that the loss was caused by that breach of contract.
I suspect that it might be worth a shot at reclaiming some of the expense back from him.0
