Curry;s PC World service contract



Three
and a half years ago I purchased an oven and two fridge freezers
from Currys for rental properties At the same time I purchased a
five year service contract on all of them The oven was installed
by my kitchen fitter into a new kitchen
Over
two months ago my tenant told me that the oven grille was not
working. I arranged by telephone with Currys to have it repaired
under the service contract. Currys have now said that the oven
cannot be repaired and have offered me the cost of a replacement.
However, it seems that I shall have to bear the cost of installation
and disposal of the old appliance.

I right in thinking that these costs should be borne by Currys? My
tenant has now been without a working oven for over 8 weeks, most of
which has been waiting for a part which they now say is
unobtainable, meanwwhile my renant has been without a grille for over 8 weeks. Is this reasonable?

This is a buisness contract and not a consumer rights one. It will all depend on the t&c's you agreed to when you purchased. Without knowing what these are, it sounds about right though.They still have a cooking appliance, just not the grille. How much cheese on toast do they really consume?!1

You're claiming on the service contract, so the terms of that determine if the extra costs are covered. I doubt they are, but you need to read it to check.
You'll also need to check if the service contract is valid in the circumstances, the cooker being a landlord's purchase for a let property.0 -
If its care and repair then the terms say:
"If we cannot repair your Product you will be given a Currys PC World voucher to obtain a replacement Product in one of our stores. You will have 12 months from the date of issue of the voucher to use the voucher. The value of the voucher will be based on an equivalent or similar specification product up to a maximum of your original Product purchase price. We will also provide you with a Currys PC World voucher to purchase delivery, installation and recycling (where applicable)."1 -

It is unfortunate for the tenant but owing to Covid "it is what it is"
These service contracts are a waste of money in most cases as I will demonstrate
If you buy SAMSUNG UE55TU7020KXXU from Currys they will charge £629 and offer a 5 year plan for £164

You are getting substantial betterment by getting a brand new appliance
I would not use the word susbstantial, many/most of my tenants in this flat are single people and few use the oven. I would therefore expect an oven to last 10-20 years. I have just had to replace a dishwasher which was over 25 years old.
This was my first (and last) purchase of one of these contracts, and my last purchase of anything from Curry's I have just spent
90 minutes in their Reading store sorting this out as my emails have been ignored.You never know how far you can go until you go too far.0 -

I hope you have offered the tenant a refund on the rent for the 8 weeks they have been without a oven, and had to order takeaways to feed themselves.

Why? The OP purchased a service agreement that said that if the appliance was beyond repair, they would get a voucher for a new one. So that's what they should get.
If it sticks, force it.

They would be very unwise to do so, that would be a prima facie breach of contract .
I hope you have offered the tenant a refund on the rent for the 8 weeks they have been without a oven,
