Been reading through the forum like a madman last night.
Essentially. Two parking charges from 21/10/2015 & 14/01/2016.
The vehicle was a lease in my parents name (used by a different family member). My parents moved property in March 2015 (seven months before the first PCN). DVLA were informed of the updated way before then but I think the Volkswagen (the lease company) were never informed of the address change...stupid I know.
The first correspondence my parents received was on 13th Jan 2021 from DCB Legal (letter of claim). Foolishly I told them to ignore it, as it appeared pretty sketchy.
They then received a claim form from the county court with issue date of the 21st April 2021. My father completed the MCOL and AOS. He actually wrote his defence on the online form of events that happened...nothing even close to the template on here. That was then submitted. 27 days later DCB Legal responded to say they intend to proceed and attached a copy of their N180.
I was informed of this last night, so I've done as much reading as possible.
This morning I have sent emails to all the relevant parties at Roadchef and Moto, in the hope to get the PCN's cancelled.
I have submitted a SAR to CP Plus/Group nexus and also informed DCB Legal of this.
Have I made any glaring mistakes or missed doing anything this morning?
Ideally, the charges would be cancelled but in the event the landowners do not comply, my father (being a senior citizen) does not want to go to court, so should he call up number on DCB Legals email to try and negotiate a settlement? Letter of claim was £340. County court claim form shows a total of £571.
It goes completely against the ethos of this forum but he would be happy to pay the original (albeit extortionate) parking fee of £60 per PCN (which is how much I think they normally are?).
Any assistance would be greatly appreciated

Same as all the other MOTO and Roadchef threads. Get the CEOs to cancel them and I am glad you have read this now! All have been cancelled so far. Don't take ''no'' for an answer, this simply is NOT ON that Motorway Services might let their out of control parking operators sue people for stopping to rest at services in 2015. Outrageous.
You appear to have done some good reading. Be like a dog with a bone and tell us when MOTO and Roadchef cancel. They have cancelled others at court stage so the fact this is a late request makes no difference, same as all the rest.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

DCBL are scamming you, simple as that. YOU MUST point out to the CEO that their operator CP Plus is now trying to extort money from you ..... give him the amounts and this is the penalty for daring to stop/shop in their service station.

I used @larry63 letter as a template and amended slightly to appeal to their 'kind nature'. Still quite stern though (will post it on here if successful, for other to use).
As a shot in the dark (as my father already submitted a poor defence on the MCOL gateway) I also amended the defence template on here and sent it following KeithP guidelines to CCBCAQ@Justice.gov.uk. However they responded within an hour to say they already processed my fathers defence on 27/4/21 and they sent out the DQ on 30/5/21, which needs to be returned by 18th June.
Hopefully I can get MOTO and Roadchef to cancel the charges before then.
If they don't get cancelled, my father does not want to go to court. He's absolutely mortified and scared sh**less about the entire situation. On the DQ there is a Settlement/Mediation option.
As previously mentioned he would rather pay than go to court. Are there any ramifications of this mediation process?
For example, if they offer to reduce the charges to the original amount he will pay in a heart beat but if they are ars*holes about it and won't be fair, will there be any knock on effects if no resolution is reached?
Terrible I know. They shouldn't get a penny and if it were me, I'd go to court but I need to respect my fathers wishes.1 -

Tell your dad we understand but, going to county court is easier than going to the dentist
DCBL are scamming you together with CP Plus
If it does go to court, with all the amazing advice you have been given, in my opinion, DCBL will get a good spanking as with CP Plus. I would love to be there
CP Plus and the two man band Group Nexus have bitten off more they can chew,
Their employers being MOTO and Roadchef ... we know that MOTO and Roadchef are not scammers but they employ them.
I am sure that by now, MOTO and Roadchef understand the problem they have, not only with the public but with their retailers
Next stop has to be the Transport Secretary to get the motorway signs changed to include "if you fall asleep in a service station you will be charged £100 followed by a legal extorting money"Rt Hon Grant Shapps MP will of course know Robert Jenrick MP who is in charge of the new code of practice ......
Might just hit home how badly the new code is needed and to ignore the bleeting cries from the parking industry and the pointless ATA's

I had a response from MOTO. Very pleasant and amenable. They offered to cancel as a gesture of goodwill. So extremely happy with that.
Just waiting to hear back from Roadchef now. Been keeping an eye on larry63 thread and he still hasn't received a response from them either (and like myself had MOTO cancel the PCN). Hopefully hear something soon.

RoadChef did respond stating it would be difficult to cancel the whole amount because Group Nexus had listed the costs, one of which was debt recovery costs ????
The OP replied giving RoadChef the facts about this fabrication and Madam Snake made available the DRP screenshot stating "no win no fee"
The OP requested his reply was seen by the CEO of RoadChef.
I assume this was a shock for RoadChef and they are investigating. A reply is expected from RoadChef
We have all noticed that the claims relating to MOTO and ROADCHEF are zero at present
