Asbestos Artex

Evening all.
Im just about to complete on a house I really love. I didn’t get a bargain, but it’s what I want. There were some issued raised in the EPC, and then In the surveyor report. The heating system needs upgraded. I accepted that this expense is down to me. However, in order to upgrade the system, a ceiling would have to be partially removed. I’ve just had the artex sample back and it contains asbestos. Whilst the surveyor noted that the artex at present is safe, and if I wanted too it could simply be plastered over, the upgrading of the heating will cause it to be disturbed. This is an additional cost and money I will struggle to find. 
As this was not declared by the vendor or estate agent, do I have any grounds to request it is sorted before completion?

    No, as it is usually picked up in the survey to test artex as a possible source of asbestos.
    The only way you could claim against the vendor is if you had proof they knew the artex contained asbestos and deliberately did not tell you.
    You could try to renegotiate if you have not exchanged though.

The only way the vendor would know if there was asbestos was if they had any work done to disturb it which your surveyor clearly stated it is safe and if you want to rid the Artex to just plaster over it. There is nothing wrong with the ceiling and its just that now you want to alter/develop the property you will have additional costs. The woes of homeownership im afriad.

    Its entirely up to you, there are no rules as to what you do or do not find acceptable re price.  Similarly, there are no rules as to what the vendor is happy with.

    I'd factor in how happy I was with the rest of the house, the price I was paying and how much the value of the house has increased since the offer was accepted and now.

    You could certainly ask for a reduction based on dealing with the artex. 

    The EA or vendor was in no obligation to declare the artex as it was in a safe condition.  Older houses usually have lead paint and maybe asbestos.
