    The OR can only attempt to recover preference payments 2 years prior to the bankruptcy order if they were made to an “associate” (which includes a family member), it’s 6 months if they are not an associate. If you can hang out until 2 years after you transferred the money then your mum will not be liable to repay it.

    I think thats the best bet carry on as i am
    untill 2 years as passed and take it from there.

    Morning all,
    I was just wondering if i went down the bankruptcy route would i get an ipa
    i do have surplus income, but i have read on this forum that if all income is benefits related you don't get an ipa

    This is indeed correct, as long as all your income is from benefits then you will not receive an IPA.

    Ahhh i just thought because i have got  like 300 surplus then a could potentially get1.
    The income is child dla  universal credit carers allowance and child benefit.

    Do you think i should lower the benefits what i am entitled to just to make sure i do not get an ipa if i choose to go through with it.

    No - you claim what you are entitled to and - as has been said- you don't get an IPA from benefit income.

    Your child’s DLA is not your money, it’s to benefit your child. So you put it down as income and then you put outgoings for Childs Disability as the same amount.
