hi there, can somebody help me?
i bought an item worth £150 pounds from a seller in January. It was sold from him brand new and he stated that in his listing.
The item is now having problems which may need repair. I didnt get any warranty info in the box. I have contacted the seller and he is unwilling to help me.
Is the seller obliged to help me either by supplying me with the warranty information or to replace the item or to take it back?

Why did the OP wait 11 months before contacting the seller for warranty info anyway?
If it's from a private buyer then surely the same laws don't apply as if it were a business selling the item?
Let's put it this way...if YOU sold something on eBay 11 months ago and the buyer came back saying there was a problem with it...what would YOUR response be???????if i had known then what i know now0 -
It depends what it is, should it be fit for use for longer than 11 months without repair? If it is you can ask seller for repair or go direct to the manufacturer with purchase details if applicable.
Best to contact CAB, I doubt there'd be any recourse to Paypal at this stage.
Having said that if you've had use of an item for 11 months that cost £150, I'm not sure its worth bothering following anything up!.0 -
If they are trading as a business then I would expect them to at least help you get it sorted out. If its a private seller you may have a bit more of a problem.
Just contact them again and tell them that you are willing to post it back to the manufacturer but that you need an invoice/receipt and could they please provide one.

he can only ask seller for a repair if the seller is selling in the course of business, if they are a business seller then quote the sale of goods act, it may be hard o prove after 11months however that the fault lays with the seller/item and not you

Hang on a minute guys! i bought the item in good faith, the item is a very good piece of professional audio equipment sold as brand new by the seller. Therefore the seller should have some form of proof of purchase, which he says he hasnt. I want to know my legal rights if i have any! I waited 11 months before requesting warranty info as the unit has only just started to play up and i didnt realise the info wasnt sent with the goods!0
