in Credit cards
Hi, i bought a car in September and paid £14,000 in full. I paid £300 of this on my credit card. In january the car went completely faulty... I took it to my local garage (because the original dealer is miiiiles from me)... I was quoted £1000s ... I spoke to original dealer who initially laughed at me, but when i quoted consumer rights etc... I then had a phone call from 'the owner' who told me he had cancer etc... Anyway, He agreed to fix it... 8 weeks later i got the car back... For it to then pack in again! This time he refused to fix it unless i got the car to him.. (it literally wont even turn on) he even offered to buy the car back off me to whatever the value is now that it doesnt work!!!
Anyway, i know that under consumer rights I have to give him an opportunity to fix it... Ive given him 2 chances AND it should not inconvenience me at all (i had ti jump on a train and make a 6 hour journey round trip to pick it back up last time!)
I've submitted my section 75 claim and I've been told they're going to contact the dealer directly.... My question is, what actually happens? Who gives us the refund?
Also, is it likely my claim will be approved?

If its a S75 claim then it comes out of your banks own pocket, they technically have a right to attempt to recover the monies from the other party but its not common for them to do so.
If you can prove your case then there is a reasonable prospect, if you don't have evidence to support it then they may reject it. They will also be double checking the necessary relationship between the parties etc.0 -

One thig you might want to double-check is that the name on your card receipt matches the name on the car invoice ie that you paid the seller the £300 and not some intermediary that subsequently then passed it on the the seller.0

There is no set timescale, the more complex the case, and you'd imagine the higher the value (see as it comes from their pocket), the longer it typically takes.0

Given they will be talking to the dealer to try and reach some agreement.
