Who is responsible? - the manufacturer or the seller.

At the end of this March I purchased a brand new Lenovo Laptop from a well known online site. The laptop worked fine for 6 weeks until I spotted a tiny mark on the screen underneath the camera. This mark, over a day or so, developed into a crack and the laptop screen failed. At no time did the laptop suffer any accidental damage and is in perfect condition apart from the crack.

I immediately contacted the store who told me to contact Lenovo and initiate a repair under my warranty. I spoke to Lenovo who asked me to post it to their repair centre.  After 5 days, Lenovo sent me a quote for £250 to repair the screen stating that screens aren't covered under their warranty. After protracted discussions with them, they told me to contact the Laptops Direct as the failure of the screen was the responsibility of the seller.  My laptop was returned to me 3 days later in substandard packaging and missing the charger, the original packaging and all the associated paperwork.

I have since gone back to the seller and explained everything Lenovo has said and they are insisting that Lenovo is responsible and not themselves. I am now saddled with a £1000 laptop which does not work. Any advice on who is responsible for the repair of my laptop would be much appreciated.

    The retailer is responsible and any legal proceedings would be made against laptops direct. You could start by sending them a letter before action but they may claim it was accidental damage that caused the crack.
