I am having it back as credit on my account, it’s not a credit agreement I wouldn’t get this if it was. My daughters phone is a credit agreement , mine isn’t the phone is included in the package.

Yeah the phone is included in the package and your paying for it over a set time. Because your using services and then paying for it after the use its a credit agreement. You haven't paid for the phone in full and also you kinda terminated the package early so you can start a new one which is why they taken the 147 quid.

Sorry but if you get a phone as part of a package and it's not been paid for upfron then it's a credit agreement

OP you have to agreements with Tesco:

    1. A rolling monthly contract for the supply of your telephony services
    2. A 0% loan for the purchase of your phone repair over whatever period you selected when you bought it

What's happened is you've cleared the rest of the balance on the loan they originally gave you on your old phone. Just because you no longer want a new phone doesn't mean you're due a refund, it simply means now you'll only be liable for the rolling monthly Telephony contract aspect of your agreement with Tesco, so your bills will drop in size until you choose to buy another handset from them, at which point they'll give you another loan and your monthly bills will go back up to roughly where they were before all this started, depending on the cost of the phone you go for and the period of time you choose to pay it off over - Tesco mobile allow you to repay the cost of the phone over 12 to 36 months in six months increments.
