hi not too sure where to post.
I have a mobile phone contract with Tesco mobile it’s not a credit agreement but I pay monthly think it’s more like a rental agreement. My phone broke so I phoned up to get an upgrade. Had to pay £147 for early upgrade fee. My daughter said she had a phone I could have so I cancelled the contract under the 14 day refund guarantee just refused delivery of the phone like they said. Well looks like they are not refunding me the £147, been waiting for 3 weeks as they said to wait until my bill month starts again. Phoned today she said I can’t have a refund.
Do you think this sounds correct ? It’s gone through to a different department now.
Thanks

I think your on a pay monthly contract.
Whats the reason they gave for not returning the money ?0 -
It’s a pay monthly but it’s not a credit agreement so on my credit file shows as zero. They said because it’s a credit agreement I won’t get a refund. I said no that’s not correct, what will my bill be going forward? It’s going to be exactly the same. Hoping i will receive a calm today. Will let you know

Yes, it's a credit agreement, any pay monthly arrangement is.No free lunch, and no free laptop

OP did you have to pay £147 to release you from the old contract early? Or did you buy a phone for £147 and then change your mind?

yes yes it was an early upgrade fee, I am having it back as credit on my account so don’t need to pay my bill for a while

I couldn’t justify it we are just in the process of buying our first home. My daughters preloved phone is doing the job nicely

If you haven't bought your phone outright you will be paying for tbe phone and as well as for text calls and data. So because you have paid 147 quid you have paid the remaining of the contract of the phone and the phone calls, text and data. You would have been paying the phone off so its a credit agreement. They won't refund the money because you would need to pay the full contract regardless if you used your daughters phone or get a new one. The 147 quid isn't the cost for the new phone it's the cost of what was remaining on the other contract.Mortgage free wannabe

Yes that was my thought, but if you read the OPs last couple of posts it sounds like Tesco mobile have been nice and cancelled the upgrade, putting the account back onto the original contract. The account is now in credit which will pay future bills.Sncjw said:The 147 quid isn't the cost for the new phone it's the cost of what was remaining on the other contract.Debt Free: 01/01/2020
