Cancelled delivery but they still delivered

Hi. 

We bought a sofa from Harvey’s in February 2020. Since then we had the pandemic and also Harvey’s went bust. After numerous phone calls
and countless times they said they’d still deliver before Xmas we got fed up and cancelled. We received a full refund of the money we paid them on the 14th January 2021. On the 26th jan they delivered the sofa to our amazement. However, we’ve record a letter from benson fo beds ( they’ve taken all of Harvey’s accounts over) saying we owe them the money for the sofa....

where do we stand on this???

So to be clear they delivered the sofa, which you now have?

yes. We received a refund and 1 week later they delivered. They just turned up at 7:30am with the sofa while I was at work and the wife still in bed.

I suggest you contact them to get them to pick up their sofa then.  Or pay them for it.

I'm confused. You have had a FULL REFUND for the sofa, so why on EARTH did you take delivery of it???? Surely when they turned up and tried to deliver it, you just needed to say to the delivery person "no thank you, the order has been cancelled and I have been refunded, please return it"?

By accepting delivery you have complicated matters, and either need to return it without using it, or pay for it. You will need to double check on who is responsible for the cost of return delivery now, as having accepted the delivery the order is now complete, so it is possible that you might now need to pay to return it.

EDIT: Noticed it was delivered 4 months ago. Have you been using it?!?!? If you have, then this would be deemed as acceptance of the contract so you need to pay them ASAP before they take it to court.

If you didn't refuse the delivery of the sofa, you accepted it. Along with the cost.  I'd be counting my blessings I got the sofa I ordered under such conditions - you must have liked it to order it.  I hope you are enjoying such a pleasant surprise, sometimes things do work out, thank goodness. 

But I am sorry, you do need to pay for it..
