Delivery dispute

I ordered a sofa from Harvey’s who have gone into administration, after months they gave me my deposit back telling me that they would not be honouring my order. I then received a text in January saying my delivery was coming the next day. I called the delivery company who said they had to attend and then I just needed to refuse delivery which is what I did. 4 months on I have now received a letter asking for payment as Panther the delivery company have not told them that they did not deliver the sofa. I am finding it very difficult to talk to anyone about this as it is being handled by the administration company who will not take calls. Any advice

    If you have received a letter I assume it has an address on it that you can contact them at, send a letter explaining what you have put here and see what they say from there
  • The letter has no address just a number to call to make payment. The number that is on the letter is even wrong

  • Thank you, I made the order before this date. The dispute is that the delivery company haven’t told the administrator that they did not deliver the sofa. Was wondering where I stood with this as it is my word against theirs

    1) How did you pay the deposit, how did they give it you back? Find any paperwork relating to this, as it will help with your claim that they voided the contract.

    2) How did they tell you about the order cancellation? Please say in writing, letter, email, text -- again, that would help. If it was a phone call, do you have a recording? If not, can you give a date, and let them find the recording?

    3) Ask for a copy of the proof of delivery (which you know doesn't exist).

    Who was the finance provided by? Harveys themselves or was it underwritten by someone else? Creation or Ikano perhaps? 

    If no finance, I don't understand the issue. Just ignore it unless/until they send a lettter before action. 

    If finance is involved then yes you'll want it corrected as it could impact your credit history/record.

  • I paid the deposit on my credit card and have the proof that it has been refunded. They told me on the phone that my order was one of the ones which were not going to be honoured and this is what instigated the refund, I do not have this in writing but I do know that this has been added to my account Harvey’s end. I did ask for them to email me my notes but the girl said this was not possible. I have now contacted the delivery company but they will not give me any information as I am not their customer, they have said they take photos of delivery so I now need to get the administrators to ask for these.
