I have started this thread for some assistance with a penalty charge notice and a letter of collection from CP plus. I have read the newbie forum but because I can’t appeal, I wondered how to go about this.

I recently received a letter of collection for a penalty charge notice, from DCBL, funny thing is the penalty charge notice is dated for 3 years ago! I never ever knew I had been issued a penalty charge notice and now as it’s been passed on to DCBL it’s included additional charges.
As I have never received a single document or correspondence relating to this, I was never aware I have been issued a PCN. I tried to appeal the PCN but as it’s dated 3 years ago the time limit for appealing has expired. I have completed a SAR to the car park owner and need to confirm my identify which I will do but what are my next steps as I can’t appeal?

Hello and welcome.
You need to ask yourself why you've heard nothing about this incident in the last three years.
Is it because your vehicle's Registration Document (V5c) has an out of date address on it?
Have you moved home since the alleged parking incident and failed to update the V5c accordingly?
Please check the V5c - don't guess.
Also you have used the word penalty four times.
You have not received a penalty and I suspect CP Plus don't use that word.4 -

If it's the former, they won't hold any of your personal data, but you could fire a complaint to them about the harassment you're receiving. Is it MOTO, the motorway services operator, there's great success in complaining if it is them.Your SAR should go only to CP Plus. Send a copy of your V5C, that's all that's needed, but expect them to come back with a questionnaire asking whether you were the driver (DO NOT respond to that!) and for a copy of your passport or driving licence, neither of which you give them. If they insist on these, just make a complaint to the ICO.If your letter is from DCB Limited then you're just at the debt collector stage, and it can be ignored safely. If you get a Letter of Claim from DCB Legal, or a formal court claim via the Northampton CCBC, come back on this thread for more advice. Meantime, you need to get ahead of this game, and you can do that by reading and absorbing two sections of the NEWBIES FAQ sticky - the 4th post about debt collectors, a very quick read, and, more importantly, the 2nd post which covers the entire court process.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Have you read the newbies? Have you complained to your MP? Has the PPC used the word "penalty"?

I do not believe that dcbl said the word penalty !!

Your SAR is emailed to the DPO at C P Plus , not the owner4 -

I have completed a SAR to the car park owner and need to confirm my identifyNot by filling in Group Nexus' form, telling them who was driving (clearly not). But you also need to tell CP Plus and DCBL to erase your old address and note that the correct address if the one that DCBL just used.

Thanks for the response, I have read through the newbies forum post, that's how I knew to complete a SAR.
You're all correct it doesn't mention penalty anyway.
I have since sold the vehicle circa 2 years ago but do recall that the V5C was not at the correct address and put this right at the time of selling the vehicle. You mention I need to email a SAR to the PPC, this is the private parking company - CP Plus Ltd T/a Groupnxus - are they not the PPC? The location was a Roachef service station. Is this who I should aim the SAR at too?Groupnexus have responded to the SAR requesting a question is filled out with proof of ID which I note in Umkomaas response not to do to this, I no longer have the V5C and they are stating the SAR is not valid until I proof my ID, in this case I submit a redacted utility bill?
Reading the newbie forum, my next step is to complain to Landowner & retailer to see if that gets anywhere but then ultimately wait for a court claim to arrive?
