Just to be clear, it is 28 days after the s172 request was served. It is presumed to be served 2 working days after posting (unless the contrary can be shown). Provided there is proof of posting, that presumption holds good even if the notice was not received at all. If the defendant wants to defend the matter on the basis that it wasn't served he has to prove that it wasn't.0 -
It was sent back in time but there is no proof of postage. Would it be best to wait until 1st June and then try to follow up again by phone and email?Johnmcl7 said:

From looking online there is usually a reminder sent out when you don't respond to the NIP, no reminder was received.
There's also evidence of the email sent chasing it up with them in December that they still haven't replied to....
The worrying part is the online portal doesn't show a tick next to the box that would indicate the driver has been identified. Hardly fair that they can be taken on their word that letters were sent but the word of the potential offender is worth nothing.
Obviously want to find out where this is up to and face it head on, not to be surprised in a month or two with a summons.
