Would this barking be a statutory noise nusiance?

I am sound sensitive so don't know if i should put up with the neighbour's dog barking as it is reasonable, or whether it would actually be considered a statutory noise nuisance.
New neighbours moved in with a small dog (semi detached house). They leave him alone to go to work for 9 hours a day. He will typically bark when they first leave him fairly consistently for 1-2 hours in the morning then settle down and be OK for much of the rest of the day. Noises will set him off but only for around 5 minutes. When they go out odd times in the evenings or weekends, he will bark from when they leave until when they return (1-2 hours).
He does not bark when they are home and no issues at unsociable hours.
We have let them know and they started playing music for him (very low level so not disruptive to us at all) as a way to give him company I guess. We informed them after one day where he barked pretty much all of the 9 hours.
It impacts me negatively, I feel highly anxious about them leaving the house and feel like I have to tiptoe upstairs when they are out for fear of making a sound that could disturb him.

Some of his barking would be a statutory noise nuisance because it goes on for so long. It seems like they are trying to do something about it, so I think I would keep giving them the feedback about what works and what doesn't.
It's not unreasonable to expect them to do something about the problem, but it may take some time for them to sort out the training that would stop this, if indeed it can be stopped. I would start keeping a noise diary, in case you need to report it as a statutory nuisance.The comments I post are my personal opinion. Leaving him for 9 hours is unforgivable. I would scream the house down if I was locked up with nothing to do1
