Why do you think you need to go to court? Tthe link i sent says:The respective amounts due to the landlord and tenant may be settled either by:[8]
- the landlord and tenant agreeing on the amount to be received by each
- using the scheme's dispute resolution service
- by the courts, in which case the court's decision must be final (there must be no appeal outstanding and the period for bringing an appeal must have expired) before any amount can be repaid
- So you have the option of using the schemes dispute resolution service.

When we requested our deposit back online (through the protection scheme) we had two options. One was just a normal request and then there was a statutory notification. It said if you don’t get a response from the normal request within 14 days you can raise the statutory one (which started some sort of legal process I think) and get it back that way. Maybe ask the letting agent what their next steps are if they continue to not get a response from the LL?1
