Council Tax - Estate liable until names on Deed changed

Probabte is through, deceased is on the title deeds of house inherited by we two siblings. Other sibling was living in property , continues to live there and starting paying CT after death of title holder ( father ) Question:Trying to do things correctly as Executor, so I believe Estate is responsible for CT until the Title deeds change to our names? Furtther sibling in house is owed the CT by the Estate as a debt so must be paid before final distribution of Estate ( Estate has cash funds ) . TIA

Occupier take priority on liability for council tax over estate or owners.
If there was no one living there the estate would be exempt of CT from DOD to 6 months after probate.
Typically the occupier takes over all bills unless agreed by the estate, like they are there in part as house sitter.
If they are using it as their home and will continue to do so they should be covering the bills.

The sibling who was resident is liable for the council tax charge from the point of death as per s6 of the LGFA92, even if they didn't hold the tenancy. I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.2 -
