Well I’ve never seen these regulations so maybe they should make it more obvious. Thankfully I am an overthinker and didn’t just jump into switching as I’d be £400 a month worse off on UC than I am on tax credits if I was getting capped each monthcalcotti said:Sadly I think ice queen is right. Regulation 82 (4) does specifically exclude income arising from application of the MIF as being counted. So both the MIF and the benefit cap could apply at the same time. This avoids the possibility of the application of the MIF actually increasing a claimant entitlement.

I agree, it would be very simple to make this clear in the easily available public guidance.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.1
