PPS want to transfer husband parking debt to me

My husband and I separated for some time last summer and unknowingly he got a parking ticket for me using his car in a private car park and staying after 6 (still chargeable) so it was addressed to him.  He got calls from debt collectors last year but thought they were hoax calls so ignored them. A couple of months ago he gets a letter threat saying BW legal have been instructed to take him to court for PPS UK. So he explained why he hadn’t got the parking ticket and that I was the driver. 

I confessed and sent PPS an email saying I accepted liability but said I wouldn’t deal with a debt collector so not to send my details to them. PPS do the opposite, forward all my personal info to BW Legal who reply and say I need to liaise with them.  PPS say I have to take on the charge in its current state but this seems very unfair as it’s gone from £60 to £160 and it’s not my fault I didn’t read it or appeal it, just a very bad patch last year.

any suggestions? I really don’t want it to escalate to court but I don’t feel I should legally take on a debt in my husbands name even if I’m at fault for the charge?

    Legally you are  the one who has  to deal with this, in the eyes of the law your husband is blameless.

    You have two choices, pay or fight.  If you opt to fight you will have a lot of reading to do, start at the newbies.  Also complain to your MP.  As they have added an extra unlawful £60 read this.

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    Have you complained to the landowner yet? That is always plan A. Where did the alleged event occur, and what type of car park was it?

    Instruct the scammers, PPS UK, that since liability has been transferred to you, they now need to send you a notice to driver as per the strict requirements of the PoFA 2012. Until they do so, they have no legal standing to commence action against you.
    By not sending a NTD they have denied you both the right to appeal as driver, and the right to make an independent appeal as required by the ADR Act 2015.

    Complain to the scammer's ATA as above. I suspect it's the IPC but we need you to confirm.

    Complain to your MP and ask them to contact the MP where the alleged event occurred.
