Claims Handlers for Buildings Insurance; What to do if they are useless?

My claim for water damage from an upstairs flat is being managed by Gallaghers, who are primarily an insurance broker so I suspect conflict of interest.
I have been in the building trade 10 years. I'm also a RICS qualified Surveyor. They are denying a legitimate claim at every turn and are simply wasting my time until I go away. Has anyone had similar experience and what are the options to make a claim if I terminate their services?

Did you commission Gallaghers or did your insurer? If it was your insurer then complain to them.
  • It was the insurer who referred the claim to them. Thanks I will approach the insurers, Zurich.

Whilst brokerage is their main business they do generate significant revenues from TPA like this but also consultancy, software etc just like all the other massive brokers.

They are agents of your insurers so put a complaint into your insurance company.

Are Gallaghers working on behalf of the tenant/occupier of upstairs, or the buildings insurer?
Who is the insurer that Gallaghers are working on behalf of?
What was the cause of the water damage?
Are you claiming via your own policy, or direct from the 3rd party?

  • Gallaghers are working for Zurich who are the building insurers for a terraced house split into 3 flats.
The water damage was caused from old, leaking pipework from the bathroom of the flat upstairs causing partial collapse of my ceiling. I am claiming from the building insurance. Gallaghers are saying the collapse is due to normal wear and tear despite photo and video evidence, Council nuisance abatement order, water damage evidence and new pipework and flooring fitted to the upstairs bathroom.

Presumably the freeholder is the policyholder? In which case complain to the freeholder and have them take it up with their insurers. Depending on the size of the entity they may or may not be able to go to the FOS if they're not happy with Zurich's response
  • Yes freeholder is policyholder. I will complain to the freeholder. Many thanks for your help.
