  • Looks like a case of negotiation then.
    Ideally I'd like to find something technical/ legal. i.e a failing on their part that would strengthen my hand. I'm kinda looking for anything from not having retained the signed credit agreement/ not having met their persistent debt obligations, not providing account information, not providing correct notification of reassignment of debt. Any possible angle that I can then ask for evidence showing they've met their obligations in the hopes that somewhere they are unable to do so. 

    I've raised a complaint in any case. Explained my position, and advised that the complaint resolution outcome i'm looking for is for the current balance to be written off. I guess at least that way I can escalate this to a regulator complaint in the event a mutually satisfactory resolution is not achieved via their internal complaints process.



  • CCA would mean debt wasn't enforceable sure, if they have it or can supply a copy, you're still on the hook
    You've ignored the posts about persistent debt - again, doesn't apply retrospectively and you need to answer the questions asked previously - did they have an updated address for you or were they perhaps sending you persistent debt letters to the last known location? This applies as well to account information.

    Got some good news this week.

    Received a call in response to my complaint advising that having reviewed the case they were clearing the entire balance, marking the account as settled, and they told me that I should cancel the direct debit immediately to avoid any chance of more money being collected. 
    Pretty pleased with the outcome, and very happy that they saw things my way straight away without me needing to push/ negotiate at all.
