Ring the local court next week, to check you haven't missed any directions or hearing info.

Ignore the desperate emails from the solicitor.

Thank you all for the responses. Especially fruitcakes 😂.
    Reassuring I can ignore.

I have emailed the court, (no luck contacting them on the phone previously - automated message that advises enquiries by email then disconnects), with an updated address of service. No reply / acknowledgment.

But I’ll email and write to them again and try to get acknowledgment. I keep mail forwarding in place as a backup.

Returned from holiday today to a notice of trial date - so looks like they’ve updated my address of service.

Trial date 10th of May. Telephone hearing.

However I haven’t previously received any directions to submit evidence.
Calling the number at the bottom of the letter goes through to a non-functioning number.

Is it normal for no evidence to submitted prior to the trial. On page two they only asked for a phone number. The newbie thread explains page two should give instructions for evidence submission.

Due to the timing of the letter - arriving whilst I was away (arrived on the morning of my flight) it will be challenging to organise time off work. Am I entitled to seek a later date when I email giving my phone number (I suspect the answer to this will be no, but if there’s a formal way to pursue this it would be helpful).

    Thanks In advanced!

The letter (or the earlier Notice of Allocation from months ago) will say when you must file and serve the evidence.  Usually not less than 14 days before the hearing, but if you haven't had the other side's yet, then you are both late.

Unless this is merely a 30 minute 'directions hearing', no it's not normal not to be required to file and serve evidence.

    Oh interesting.
    Nothing received from the claimant.

I have a notice of proposed allocation from July
Then a transfer of proceedings from July also.

Neither includes dates for evidence submission.

Yes they do, look again at page two - it is in one of those orders or the hearing order.

Unless it's a waste of time 30 minutes?

    N149A proposed allocation
N271 Notice of transfer of proceedings
    N172 Notice of trial date

Re-read all of them several times no directions re: evidence submission.

    Nothing like this anywhere?...
Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].

So a letter was sent in Sept that I never received according to the court enquiries email.

I was feeling pretty deflated as I thought I wouldn’t have time to submit evidence and organise time off work (which would
have been unpaid either way). So thought I’d be paying out twice effectively by attending the hearing.

Instead on the deadline to make the reduced payment (today) I received an N279 from DCBL.
I assume they found the defence enough to no longer see me as low hanging fruit!?

Thank you guys for all of your help and this amazing forum that empowers average Joe to fight back against these crooks.
