Hello
I have given notice on my house and went to investigate the deposit just to confirm that it has been protected.
I have checked with the deposit company they said they had used and they don't have a record of me.
How easy is it to get the ball rolling on asking for compensation for it not being protected.
Have checked my emails and all I have regarding deposit was the information about the scheme it would be put in when they asked me to send over my deposit.

BUT...
If they simply and instantly repay you the entire deposit, it's unlikely a court would order more than that.
Yes, the maximum is 3x.
But that's most likely to be awarded in cases where the landlord has been intransigent in repaying anything at all.0 -

Yes have checked with them. They said they don't have it there.
Landlord is telling me that it is protected he just needs to dig out the paperwork for me0 -
If it's protected you'd normally get an email from the scheme with details of their online portal0

They admitted it wasn't protected. And they are arranging to give me the deposit back before I even leave the property0

So, sue them for non-protection once you have it back. You will get a minimum of the full deposit value, plus your costs. You will win, as there is simply no defence to this breach. LBA first, then small claims process
