Yes, the car expert article is, perhaps, more confusing as it tries to cover cancelling the order in all circumstances. Yours was an "off premises" purchase, so the part to look at specifically says:
"If you bought a car at a distance or off-premises, then you are entitled to your full deposit back, regardless of your reasons or any money the dealer has spent."0 -
As I said in my very first reply, as this was all done online it is classed as a distance sale and therefore you're entitled to a full refund of your deposit under legislation in relation to distance sales - The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to give it it's full title, CCRs for short.Geranium44 said:Reading them I think I have to accept ill Have to lose a ‘reasonable’ part of my deposit. Top advice.I’ve tried calling the Bmw Dealership but as it’s bank holiday I’m not getting a call back.I’ve also spoken to my credit card people who said ‘it depends’ on whether I can recover the deposit based on what contract exists.From what you’ve said above, I’m tempted to go back to my CC people and share your comments and ask for the deposit payment to be cancelled.Is this advisable? Thx0

as a retailer it must be annoying and what is the point of a deposit if it is refundable
I think it's a side effect of the sales pitch, where if you show interest in a car you're pressed to leave a deposit before coming in to look at it.

The deposit scares timewasters off, but also benefits the client if he's coming from a long way and wants to be sure the car will definitely be there.

Update. one of the BMW salesmen said today I will be refunded the £1k via a business manager who will call. Still waiting for the call expect it won’t be high on their to-do list.

I understand the deposit should be refunded within 14 days of request. Even if they take that as 14 days from their agreeing and are a bit tardy in processing things, it should not be too long I suppose.0 -
