Refund for missing returns

Ordered from AllSaints,  returned the order as they didn't suit. They refunded one item, when I contacted them for the rest of the refund they told me they didn't receive the other items, they told me they would do an investigation with the warehouse & the courier,  after a while they sent me an email to tell me they would not be refunding my order as their investigation show that they had done everything correctly.  And that CCTV showed only one item returned,  I myself contacted Royal mail and was told as I was the buyer, that it should be the retailer contacting them and putting in a claim for the missing items. Went back to AllSaints,  and they are still refusing to refund the missing items.  So I'm I to be left out of pocket. I've my proof of returns.

  • Does your proof of postage include the weight of the parcel? Have you shared this information with AllSaints?

    Who paid for the return? If you did then you are RM's customer and you are the one that has the dispute with them. If All Saints did then they hold all the cards as they are RM's customer and they say they got what was sent.

    The weight point is an interesting one to pursue

    Reimbursement by trader in the event of withdrawal or cancellation

    (5) If the contract is a sales contract and the trader has not offered to collect the goods, the time is the end of 14 days after—

    (a)the day on which the trader receives the goods back, or

    (b)if earlier, the day on which the consumer supplies evidence of having sent the goods back.


    If you provide them with proof of return they are obligated to refund within 14 days. As above the receipt should show the weight, if the sent weight is as expected and the weight of one item would be noticeably less I think that would suffice on the balance of probability that you've provided proof of return.
