DCBL final notice of recovery

Options
Hi -

I have checked the Newbies thing but I have questions. If anyone wants to be annoyed by this question then stay quiet. Answer if you can please.

Received (in my partner's name as it was her car) a final notice of debt recoevry for £150 for parking in a disabled bay in a private car park (she was 8 months pregnant and we popped into a shop for two mins) it was in July 2015 so I know the fine runs out in a few months. I recall the bays weren’t very visible and I didn’t realise it was a disabled bay, it was just right in front or the store, anyway…

At this stage is it wise to leave it until their next letter (they say they are recommending to their client - UK Parking Control Ltd - to commence legal action) or to contact them and ask for details of the contravention, photos and all correspondence etc (we moved shortly after that and they sent a letter a couple of months ago to current address).

I don't want to risk a CCJ as we are about to try and get a mortgage out on the house.

In short:

- Do I contact them now and hope I can delay it until after July or
- Do I leave it until they send their next letter which may be a court letter

Any help really appreciated.

There have been several threads this week where the issue is likely to run out of time (i.e. statute barred) as the PPCs only have six years to bring the claim.  If you can keep writing asking for information and also tell them that, whilst you deny any debt exists you are seeking debt advice and they must put the claim on hold for a minimum of 30 days you might squeeze past the cut-off date.

I suggest people start at the fifth post and make a note of the acronyms and abbreviations then  go back to the start

amongst all the good information ... you will find that you would need this to get to court .... then loose or ignore .... then refuse to pay .....  to get this to CCJ stage ...

She should, yes.  The idea is to stop DCBL Recovery (debt firm waste of time) from passing the case to DCBLegal for prepping a claim.

Wait till the last day the letter gives (every time) then she should reply and ask for all evidence their client holds because this is a long time ago and as registered keeper she wants to see all the photo evidence.

Then when they reply, wait another 28 days and ask for something else, ask whether UKPC are relying on the POFA or not or whether they have evidence of who was driving (that would do for the second response and should get you to June by then).

Finally if she gets a LBC from DCBLegal before the 6 years are up, she then tells them (on day 28) that she is seeking debt advice and asks them to put the case on hold for 30 days.

    Bingo - job done!

I would do that sharpish, because just looking at the date of your original post, the usual 14-day debt collection letter deadline could have expired. Your case might already be en route to DCB Legal.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So its now my turn to be a victim of the DCBL ltd scam. Ive read many a post in the forums but two questions still outstand:
    a) I never received a PCN, only the DCBL letter earlier this week, with a contravention date of Feb 2016. Does the fact i was driving a company car (I no longer work for the company) have any implications?
    b) The 'offence' was at Lymm Services, Cheshire. Do i send my SAR to UKPC? If not, to whom should i send it to?
    Thanks in advance.

Yes, it makes a huge difference if The Driver was using a company car.
Please start your own thread after reading the NEWBIES. Your situation is completely different to the OP's and it will get confusing if we try to answer two lots of questions about two different cases on someone else's thread.

Do Not reveal the driver's identity, not even on this forum. Never use words like, I drove, or I parked etcetera. Only ever refer to The Driver, The Keeper, and in your case, The Hirer/Lessee.
