Once they refuse to engage further your only option is litigation. This is expensive and will not be quick. You may well be placed in a situation where, if you do not wat to loose your house, you will have to clear the debt.MacMini said:In the event that they respond to me tomorrow advising that they are not reopening the case, is there any advice anyone has on next steps?
Thank you - Mac
It isn't the only option. After the complaint process is exhausted you can complain to the Information commissioner (ICO)0 -
Thanks - I've literally just filled in the complaint form and submitted to the ICO. The 3 months SLA doesn't fill me full of hope, but fingers crossed...0

MacMini said:Hi kaMelo - good advice - hadn't thought of that. It shows as a linked address on two (Experian and Equifax), but the default only shows up on Equifax. So, I'll raise again with Equifax directly as well as continuing to battle with Virgin...
This does not look like fraud, but more like a mistrace.
Fraud is using your details, e.g from where you lived, like after you have moved out or just to open the account.
Mistrace is someone with the same name at a different address but their trace systems have connected the two.
If it's the latter, then I can see why it isn't seen as fraud by VM. There are probably indicators that show other activity at that address.
VM connecting you to that person would create the link on credit files.
Do you have proof, e.g. Council tax bills, covering the period they claim the accounts were taken out?0 -
Hey Nic - yes - I agree - I'm coming around (with the advice on here) to the same thinking - especially as it's only showing up on Equifax, which is the CRA which Virgin use.
Yes - I have council tax bills (and a whole bunch of other evidence) showing my correct address for that period (including the fact that I'm actually a virgin media customer for TV and Broadband at my real address!)....0 -
The ICO is not going to address the matter of the OP's losses. Lost expenses on a potential aborted house move, higher mortgage rates due to the defaults etc etc etc....... These will need to be recovered through the courts.Nebulous2 said:MEM62 said:
