legality of change of tariff

Update.
After going round in circles between different eon departments and still getting nowhere, except being told we could not have an off peak tariff with the existing meters, but because there was an open complaint they were unable to arrange to exchange the meters,I e-mailed the ceo of eon.
I then found the complaint had been escalated to the directors office and was contacted by them on may 11th.I had a verbal apology, arrangements were made to exchange meters to an economy 7 meter with restrictors on for heating and hot water to only take a charge in off-peak hours.I also had an ex-gratia payment of £80 credited onto account in recognition of all the time and effort it had taken to get to that point, and it was confirmed that our bill would be re-calculated with the off-peak charges re-instated up to the installation of econ 7 meter.
The meters were exchanged on may25th,I was contacted by directors office on 26th may,our DD was reduced, the re-calculation of our bill was again confirmed, another apology for us never having notice of removal of heatwise tarriff and a further £170 ex-gratia payment applied to our account.
Despite several attempts by eon to re-calculate our bill it was still being calculated wrongly and so we went to the energy ombudsman.Eon came in with an offer of a letter of apology and a cheque for £170.00 to resolve the case.We refused this as we knew it was not enough to cover the over-charging.
The ombudsman ruled that eon were wrong to impose the changes without telling us and that we had been over-charged by £513.98 which should be repaid to us.As we had already received a total of £250.00 in ex-gratia payments no further compensation was claimed.
Eon appealed this decision but the appeal was rejected with the ombudsman ruling that the original decision should be up-held.
On oct 5th we had an e-mailed letter of apology and £513.98 credited to our account.
Really glad to get this sorted eventually, and we will wait and see how being on econ 7 works out for us.4
