Lost Popla Appeal - What next?

I wish I'd looked here before I started this!!  I've looked at the threads but can't find anything similar.

I parked in a country park car park owned by Kent Country Parks.  I had no money with me so tried to pay with the App as per the signage.  It failed due to network error.  I tried numerous times while I was walking and eventually screen shot what was happening just in case.......

I later got a charge notice through the post for no valid pay and display/permit was purchased.

I appealed on the grounds that I tried to pay but was unable to.  Euro Car Parks rejected the appeal so I appealed on the same basis to Popla.

Euro Car Parks in their reply to my appeal sent a ream of photos showing various signs including one saying that I could pay after the event and had up until midnight to pay.  As I didn't recall the sign I went back to the car park yesterday to have a look and the new sign was stapled over the previous one that made no mention of paying before midnight.  I took photos of both layers.  I added to the comments to the effect that the signage wasn't there, if it had been I would have paid.  There was no way to add the photos.

The appeal failed.  I now can't get access to the paperwork that Euro Car Parks answered with now.  Only the result!

What should I do now?

Stick Kent country park euro in the forum's search facility and read about similar cases.

    In particular, read this post:

Search the forum for POPLA & lost as keywords, would be the first step before starting a thread about something that happens all the time, doesn't matter a jot and is not a stage where advice is needed.

However, what will be interesting is to see both sides of the postal PCN or Notice to Keeper please because this is not relevant land and ECP must not mislead a keeper about liability.  We would want to check that ECP are not issuing illegal NTKs, following the LGO's decision.

You could have won at POPLA hands down, had you realised that and not said who was driving.  You blew the 100% win.

But hey, search the forum for POPLA & lost and read what we've already said to other posters ad infinitum about this normal event of losing at POPLA (so what, really!).

A loss at Popla is of little consequence. it is what a judgeb syas which matters, have you complained ti your MP,  written bad stuff of TripAdviser, the park's website, local tourist office, local media, etc?
You never know how far you can go until you go too far.
  • Unfortunately I can't find the original PCN and now the case is resolved on Popla all the documentation isn't there.....

Fortunately POPLA have to provide everything if you email and ask for a subject access request, to send you all the file they hold.
